Terms of Service

1. Service description

FieldRank is a software-as-a-service platform that helps local businesses publish jobsite check-ins to Google Business Profile (GBP) and related surfaces, and provides associated reporting, analytics, and website widgets.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you register. By creating an account, you represent that both are true.

3. Accounts and your responsibilities

• Keep your credentials confidential. You are responsible for activity on your account.
• Provide accurate, complete information and keep it current.
• Use the service only in compliance with applicable laws and these Terms.
• You are responsible for the actions of any team members or contractors you invite to your account.

4. Acceptable use

You agree not to:

• Send spam or any unsolicited messages through the service.
• Manipulate Google Business Profile rankings via fabricated, falsified, or misleading check-ins.
• Use automated scripts, bots, or non-human input to create check-ins.
• Post check-ins or content on Google Business Profiles you do not own or are not authorized to manage.
• Upload content that is illegal, infringing, defamatory, harassing, or otherwise harmful.
• Attempt to reverse engineer, probe, or interfere with the security of the service.
• Resell or sublicense the service except under our published Agency White-Label terms.

We may suspend or terminate accounts that violate this section.

5. Subscription, billing, and trials

• FieldRank is offered as a monthly subscription, billed via Stripe.
• New accounts include a 7-day free trial. A valid payment method is required to start the trial.
• At the end of the trial, the subscription auto-renews monthly until cancelled.
• You can cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period.
• We do not provide refunds for partial periods. Fees already paid are non-refundable except where required by law.
• We may change pricing on prospective billing periods with at least 30 days notice. Continued use after the change takes effect constitutes acceptance.

6. Termination

• You may terminate your account at any time from your account settings or by emailing support@getfieldrank.com.
• We may terminate or suspend your account immediately for material breach of these Terms.
• We may terminate accounts that are 14 or more days delinquent on payment.
• We may also terminate accounts for any reason with 30 days notice.
• On termination, your access is revoked. We will retain or delete data per our Privacy Policy.

7. Intellectual property

FieldRank and all underlying software, branding, and documentation are owned by Scale Systems LLC and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service while your subscription is active.

You retain ownership of the content you upload (photos, descriptions, check-in data). You grant us a worldwide, royalty-free license to host, display, transmit, process, and otherwise use that content as necessary to provide the service, including posting it to your connected Google Business Profile and rendering your website widget.

8. Third-party services

FieldRank integrates with third-party services (including Google Business Profile, Stripe, Supabase, Vercel, and Resend). Your use of those services is subject to their respective terms. We are not responsible for the availability, accuracy, or behavior of third-party services.

9. Disclaimers

The service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific outcome from the use of FieldRank, including any specific Google Business Profile ranking, traffic, lead volume, or revenue. Local search rankings depend on factors outside our control.

10. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the service or these Terms is capped at the fees you paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if advised of the possibility.

11. Indemnification

You agree to indemnify and hold Scale Systems LLC, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of (a) your use of the service, (b) your content, (c) your violation of these Terms, or (d) your violation of any law or third-party rights.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina, except that either party may elect to resolve a dispute through binding arbitration administered by a mutually agreed arbitration body. Nothing in this section prevents either party from seeking equitable relief in court for intellectual property or confidentiality claims.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the effective date below. Material changes will also be communicated by email to active customers. Continued use after the change takes effect constitutes acceptance.

14. Miscellaneous

• If any provision is held unenforceable, the rest of the Terms remain in effect.
• Our failure to enforce a provision is not a waiver of our right to do so later.
• You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the service.
